a. For single-owner condominiums, the owner is responsible for expense for operation management of condominiums except for a different agreement signed between the owner and condominium users.
b. For multi-owner condominiums, the owner and condominium users are responsible for expense for operation management of condominium based on a principle that the operation management fund shall be raised from the owners on the principle of full coverage of expenses. Fund contribution levels shall be calculated on a monthly basis and apportioned to the area or other parts not belonging to condominium (included parking lot area) under the private ownership of each owners.
c. Provincial/municipal People's Committees are responsible for prescribing the maximum collection level of condominium operation management fund in the localities. Condominium project investors shall base themselves on the maximum collection level set by provincial/ municipal People's Committees to calculate service charge and collect from the owners, condominium users (where there is not Management Board of condominium) or operation management enterprise will base on the set level to calculate operation management charge rate and request Management board to report in Conference of Condominium to be passed (where there in a Management Board of condominium)
2. Effect of the Circular
- The Joint Circular comes in effect from the date of June 25th, 2014
- For the apartment purchasing contract singed prior to April 08th, 2014 where contractual parties agreed the area is calculated from the heart of wall to the other, from the valid date of this Circular, fund contribution of operation management will be appointed to the area calculated on a base of area between walls.
