Workshop to summarize the implementation of the law on planning and propose policies in the Law on Urban and Rural Planning

The Ministry of Construction chaired and coordinated with the German International Cooperation Organization (GIZ) in Vietnam to organize a workshop to summarize the implementation of the law on planning in accordance with the Law on Urban Planning, the Law on Construction 2014 and propose policies in the Law on Urban and Rural Planning, on March 10th. This is one of the activities of the Ministry of Construction to implement the direction of the Government and the Prime Minister on reviewing and perfecting institutions, urban development associated with rural development. Deputy Minister of Construction Nguyen Tuong Van chaired the workshop. Representatives of the Government Office, leaders of the Department of Construction, the Department of Planning and Architecture of the provinces and centrally-run cities, and a large number of domestic and international experts attended the workshop.

Speaking at the opening ceremony, Deputy Minister Nguyen Tuong Van said that currently, the law on urban planning, construction planning and rural planning is regulated in two main laws, namely the Law on Urban Planning 2009 and the Law on Construction 2014, amended and supplemented in Law No. 35/2018/QH14 and Law No. 62/2020/QH14 and documents detailing the implementation of the Law.

After 12 years of implementing the Law on Urban Planning, 7 years of implementing the Law on Construction, the system of legal documents on urban and rural planning has basically been promulgating, creating a important legal corridor to organize the implementation of planning and urban and rural development, contributing to improving the quality of space, architecture, landscape and living environment of people, making important contributions to socio-economic development, environmental protection, national defense and security assurance. Approved planning projects are one of the effective tools for implementing state investment management, adjusting activities in the field of construction and directing, operating and implementing tasks and objectives of socio-economic development in each period.

However, in the context development and international integration, a number of legal provisions on urban planning and construction planning have revealed shortcomings and limitations that need to be studied, corrected and supplemented to unify and synchronize with the newly promulgated legal system, in line with reality, and improve the efficiency of state management of planning and promote decentralization in the implementing organization.

Deputy Minister Nguyen Tuong Van suggested that managers, experts and scientists focus on discussing and clarifying the results of law enforcement on planning according to two Laws mentioned above; identify existing problems; proposing solutions and policies on urban planning and construction planning on the basis of reports of the Ministry of Construction, as a basis for amending and supplementing legal regulations on urban and rural planning; contributing ideas to develop the draft outline of the Law on Urban and Rural Planning.

Speaking at the workshop, Mr. Christoph Klinnert - Director of the Climate Change Adaptation Project in the Mekong Delta (GIZ) emphasized the positive changes for Vietnam in the process of implementing legal policies on planning, especially the Law on Urban Planning, which has been implemented since 2009. GIZ is ready to support the MoC in developing the Law on Urban and Rural Planning, the Law on Urban Development Management, the Law on Water Supply and Sewerage and guiding documents for law enforcement.

At the workshop, the managers and experts actively exchanged and discussed issues related to the completion of regulations on formulation, appraisal, approval and adjustment of planning; completion regulations to improve planning quality.

Concluding the workshop, Deputy Minister Nguyen Tuong Van thanked the close cooperation of specialized construction agencies in the provinces and centrally-run cities, especially the active support of GIZ in organizing the workshop. Discussions and presentations at the workshop will create an important basis for the Ministry of Construction and related agencies to study and perfect the system of legal documents and mechanisms and policies in the field of construction planning and urban development.
